
INSPECTION AGREEMENT
Hidden Hazard Home Inspection Service, LLC, hereafter referred to as “HH”, agrees to perform an inspection of the property located
at ________________________________ for _________________________________, hereafter referred to as “Client”, for the sum
of $ ____________________ payable at time of inspection. Client agrees to release report to Broker/Realtor: Yes______ , No______ .
1. HH agrees to provide a report of it’s visual analysis and professional opinion of the condition of the residence, any readily accessible installed components, and the operation of the building’s systems, including any controls normally operated by the owner of the building, for the following components: (i) Heating systems (weather permitting); (ii) Cooling systems (weather permitting); (iii) Basic electrical systems; (iv) Basic plumbing systems; (v) Structural components (visual aspects only); (vi) Foundation and basement (where visible); (vii) Roof coverings (where readily accessible); (viii) General exterior and general interior components; and (ix) Any other site aspects that affect the residence. This inspection is not a compliance inspection for building codes and does not address environmental hazards including: (i) Lead-based paint; (ii) Radon; (iii) Asbestos; (iv) Cockroaches; (v) Rodents; (vi) Pesticides; (vii) Treated lumber; (viii) Fungus; (ix) Mercury; (x) Carbon monoxide; or (xi) Other similar environmental hazards. This inspection does not address wood destroying insects and organisms or subterranean systems or system components, operational or non-operational, including sewage disposal, water supply or fuel storage or delivery. This inspection is neither a warranty of the components nor of their future use, operability, suitability or habitability. This inspection does not address swimming pools, tennis courts, saunas, spas, whirlpools, hot tub systems, water wells and pumps, fencing, landscaping, solar systems, soils, security systems or irrigation systems.
2. The inspection is governed by the Standard of Practice and Code of ethics adopted by the State of Tennessee.
3. Should the Client be married at signing of the Inspection Agreement, Client represents that this is a family obligation incurred in the interest of the family.
4. The report will be a written report which will include any systems or components inspected as required by the State standard that is, in the opinion of HH, significantly deficient and why. The report will list any required State standard inspected systems or components that were not inspected and why.
5. The report will be based upon observations of conditions that existed at the time of the inspection only. HH will report the conditions and existence of significantly deficient visible defects of the premises, components and equipment. This report is confidential and is prepared for the sole and exclusive use of Client and may be relied upon only by Client.
6. Should any part of this agreement be declared void, the remaining provisions shall remain in full force and effect.
7. This agreement and the Checklist and Summary of Findings, the form of which is attached hereto, will constitute the entire understanding of the parties with regard to this matter, and no statements, oral or otherwise, shall be enforceable unless made in writing and signed by both parties.
8. Payment is due at time of inspection. In most cases, the report is delivered within 24 hours of the inspection. Any notices required to be served shall be served upon HH at 1200 Tarr Rd. Talbott, Tennessee 37877, (865) 389-8710. Any dispute concerning this matter shall be litigated in the courts of Hamblen County, TN.
9. In the event of a claim against HH, Client agrees to supply HH with the following; (i) Written notification of adverse condition within 14 days of discovery, (ii) Access to the premises, (iii) 48 hours for HH to respond in writing. Client shall have no cause of action against HH or it’s representatives after one year from the inspection date.
10. Any dispute, controversy, interpretation or claim including claims for, but not limited to, breach of contract, any form of negligence, fraud or misrepresentation or any other theory of liability arising out of, from or related to, this contract or arising out of, from or related to the inspection or inspection report shall be submitted to final and binding arbitration “under the rules and procedures of the Expedited Arbitration of Home Inspection Disputes of Construction Arbitration Services, Inc.” The decision of the Arbitrator appointed there under shall be final and binding and judgment on the Award may be entered in any Court of competent jurisdiction.
11. Return visits required to inspect items that were not readily accessible at the time of the inspection, will be billed at the rate of $50.00 per hour including the travel time.
THE HOME INSPECTION REPORT IS NOT INTENDED TO BE AND SHOULD NOT BE CONSIDERED A GUARANTEE OR WARRANTY OF ANY KIND INCLUDING, WITHOUT LIMITATION, ONE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR INHABITABILITY.
The client acknowledges that he/she has read this agreement in full, prior to signing name, and understands and agrees to terms and conditions herein.
